In a decision that marks a turning point for dog bite victims in New York, the New York Court of Appeals has officially struck down the controversial and outdated “one-bite rule.” The ruling in Flanders v. Goodfellow (2025 NY Slip Op 02261) allows injured individuals to file claims based on simple negligence, rather than having to prove that the dog owner had prior knowledge of their pet’s dangerous behavior.

For decades, New York stood nearly alone in requiring victims to show that a dog had previously displayed “vicious propensities” to hold the owner liable. This placed an unnecessary burden on those already suffering physical and emotional trauma.
