$3.75 Million Wrongful Death Settlement in Sullivan County Workplace Safety Case

  • An opening that was unguarded and uncovered, without OSHA-compliant barriers or protections
  • Slippery flooring contaminated with grease and wastewater
  • No warnings, no adequate safety protocols, no proper training, and no meaningful supervision when workers were expected to clear repeated pump blockages

This was not a one-time or unforeseeable event. The flooding and clogging issues were recurring. The hazard was known. Yet the proper engineering corrections and workplace safety measures were never put in place.

Expert Findings Confirmed the Case Was Entirely Preventable

Engineering experts concluded that this tragedy was completely preventable and resulted from multiple systemic failures, including:

  • Failure to upgrade the drainage system after the building’s use changed
  • Failure to install grease traps or commercial-grade pumping systems appropriate for poultry waste
  • Failure to guard a hazardous opening
  • Failure to implement basic workplace safety procedures

In other words, this death did not happen because of bad luck. It happened because safety was neglected.
